Agreement to Terms

By accessing or using Gardien Security's services, including the VIPER Security Operations Console, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Description

Gardien Security provides cloud-based security operations services, including:

• VIPER Security Operations Console with AI-powered threat detection
• Managed Detection & Response (MDR) services
• Mean Time to Respond (MTTR) Optimization
• Security analytics and threat intelligence

Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Notify us immediately of any unauthorized access

Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile our software

Service Level Agreement (SLA)

We commit to providing reliable and available services:

Data Ownership & Processing

Data ownership and processing terms:

• You retain all rights to your security data and logs
• We process data solely to provide and improve our services
• Complete data isolation is maintained between tenants
• You may export your data at any time

Payment Terms

For paid services:

• Fees are billed according to your selected plan
• Payments are due according to your billing cycle
• Late payments may result in service suspension
• Refunds are handled on a case-by-case basis

Intellectual Property

All intellectual property rights in our services, including VIPER console, software, algorithms, and documentation, remain the exclusive property of Gardien Security. You are granted a limited, non-exclusive license to use our services according to these terms.

Limitation of Liability

To the maximum extent permitted by law, Gardien Security shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services in the 12 months preceding the claim.

Termination

Either party may terminate the service agreement:

• You may cancel your subscription at any time
• We may suspend or terminate services for violations of these terms
• Upon termination, your access to services will cease
• You will have 30 days to export your data after termination

Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the service. Continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of Espirito Santo, Brazil.
